New Hamas activities raise risk levels for bankers

Recent actions taken by Hamas not only threaten peace in the region, but raise the level of risk for international banks that may be aiding & abetting the designated terrorist organisation in acquiring US Dollars to conduct these operations. It has been reported that Hamas has sent an undetermined number of its fighters to Iran for military training. Though denied by the organisation, the Israeli Defence Forces Deputy Chief of Staff has stated that Israel has the names of more than one hundred. Close affiliation by Hamas with Iran, a US-designated State Sponsor of Terrorism, increases both the risk and severity of sanctions and penalties that could be visited upon financial institutions whose dealings with Hamas become known to US law enforcement. The game has now become a bit more deadly for those banks who still choose to facilitate funding Hamas.

Other new and dangerous Hamas actions reported include:

  • Creating an armed force modeled after that of Hizballah in Lebanon.
  • Constructing advanced fortifications, fighting positions and tunnels in Gaza that are designed to engage Israel in conventional battles, which would result in catastrophic civilian casualties in the densely populated area.
  • Covertly importing large quantities of anti-armour weapons, explosives, rockets and missiles.

The fear is that any financial institution which chooses to continue to supply Hamas with currency, or sending it funds transfers through circuitous means,if identified, will be summarily classified as a terrorist financier, due to the Iran issues, and suffer the imposition of extreme US penalties, including:

  • Designation as a terrorist financier, with an order being issued prohibiting direct or indirect commerce with US banks.
  • Sanctioned through closure of its US branches, representative offices and correspondent relationships with US onshore banks and their offshore branches.
  • Seizure of bank assets in the US.
  • Targeting for criminal prosecution in the global was on terror.
  • Pressure being placed upon the EU to follow suit with sanctions.
Assisting Hamas could become a fatal problem for any entity foolish enough to do so. The level of risk has  now reached unacceptable strata.
